Development of recommendations on application of the Convention on Environmental Impact Assessment in a Transboundary Context to nuclear energy projects is going on. The next meeting of the Drafting Group will be held in August 2016 to revise the first draft recommendations.
Environmental Impact Assessment of nuclear facilities is a specific issue, particularly in the transboundary context. The Parties to the Convention decided to develop the recommendations in 2014 in response to difficulties in application of the Convention to projects of construction of new nuclear units, spent nuclear fuel and nuclear waste repositories and extension of the lifetime of old nuclear units.
Recently the Espoo Convention Implementation Committee examined several cases in the aforesaid matter concerning Armenia, Great Britain and Ukraine. The Committee concluded that Ukraine was in breach of the Convention, since it had extended lifetime of two nuclear power units of Rivne NPP without assessing transboundary environmental impact. Unfortunately, the relevant provision was cancelled in the draft Law “On Environmental Impact Assessment” 2009a-d adjusted by the Verkhovna Rada of Ukraine, so the issue remains unresolved.
